2. Applicability

By placing an order, the customer (hereinafter “the buyer”) agrees to these general terms and conditions of sale.

These terms form an integral part of the agreement and exclude any other conditions of the buyer unless expressly agreed otherwise in writing.

These terms apply to all products and services offered by Zipper Zoo and can be consulted at www.zipperzoo.be or obtained by email upon request.

3. Offer and agreement

All offers and product information on the webshop are non-binding and indicative.

Images are provided for illustrative purposes only and may differ slightly from the actual product, including in colour, size or material texture.

An agreement is concluded when the order is confirmed by Zipper Zoo.

4. Prices

All prices are expressed in euros and include 21% VAT, unless stated otherwise.

Shipping costs are not included and will be displayed separately during checkout.

Zipper Zoo reserves the right to change prices at any time. The price applicable at the moment of ordering remains valid for that order.

5. Payment

Payment must be made within 5 days after placing the order, unless otherwise agreed.

Until full payment has been received, the order remains the property of Zipper Zoo and shipment may be withheld.

In case of non-payment, Zipper Zoo reserves the right to cancel the order.

6. Retention of title

All delivered goods remain the property of Zipper Zoo until full payment has been received.

7. Delivery

Delivery is carried out by external carriers.

Delivery times are indicative. Delays of up to 30 days do not give the buyer the right to claim compensation or cancel the agreement.

If delivery has not taken place after this period, the buyer has the right to cancel the order.

The risk of transport passes to the buyer once the parcel has been handed over to the carrier. Zipper Zoo cannot be held responsible for loss, damage or delay caused by the carrier.

8. Complaints and visible defects

Any errors in delivery must be reported within 3 working days after receipt of the parcel.

Hidden defects must be reported within 5 days after discovery.

Complaints must be submitted in writing by email. Zipper Zoo will respond within 14 days.

9. Warranty and liability

Warranty is limited to hidden defects and the legal guarantee as provided by applicable law.

Zipper Zoo cannot be held liable for indirect damages, consequential damages or damages resulting from improper use of the products.

10. Right of withdrawal

The buyer has the right to withdraw from the purchase within 14 calendar days after delivery.

Goods must be returned in original condition and packaging.

Return shipments are made at the buyer’s own risk and expense.

The right of withdrawal does not apply to:

• services that have already started
• personalised goods
• patterns and books
• fabrics or materials cut to size
• fabrics smaller than 50 cm x fabric width
• zippers shorter than 1 metre
• webbing or trims shorter than 1.5 metres

Zipper Zoo reserves the right to refuse returned goods if they are used, damaged or incomplete.

11. Abuse and chargebacks

In case of abuse of the right of withdrawal or unjustified payment disputes (chargebacks), Zipper Zoo reserves the right to refuse future orders and recover any resulting costs from the buyer.

12. Privacy

Zipper Zoo handles personal data with care and confidentiality.

Personal data are used solely for processing orders and improving our services.

These data are never shared, rented or sold to third parties.

Customers have the right to access and correct their personal data. Objections to the use of data for direct marketing can be sent to info@zipperzoo.be.

13. Invalidity of provisions

If a provision of these terms is declared invalid or unenforceable, the remaining provisions remain fully valid.

14. Modification of the terms

Zipper Zoo reserves the right to modify these terms at any time.

The terms applicable to an order are those in force at the moment the order is placed.

15. Evidence

The parties accept electronic communication, including emails and digital files, as valid evidence.

16. Applicable law and jurisdiction

All agreements are governed by Belgian law.

In case of disputes, only the competent courts of Belgium shall have jurisdiction.
